If the bits of music in question really are the same I hope the court finds in his favor and awards him the full amount. Thematic lyrical differences don't really matter if the instrumentals are stolen. It just like when people don't clear samples for songs - saying "but my song isn't about the same thing!" doesn't absolve them of responsibility. And her lawyer is dumb as hell for suggesting that her sales and Grammys mean that she's above stealing. This is the same woman who tries to count DC4/3 sales along with her solo work for bragging rights. Every solo album she has released has involved some sort of stealing whether it's lyric credits, music, video concepts, bits of choreography, or concert costumes and staging. She's a KNOWN thief.
